Welcome to Buoy.Fish. These Terms of Service (“Terms”) govern your access to and use of the buoy.fish website and the Buoy.Fish maritime asset tracking platform accessible at app.buoy.fish (together, the “Service”), operated by Buoy-Fish, Inc. (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.

2. Account registration

To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete registration information; maintain the security of your credentials; promptly update your information if it changes; and accept responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

3. Description of the Service

Buoy.Fish is a maritime asset tracking platform that enables users to:

• Register and manage GPS tracking devices for marine equipment
• View real-time and historical device locations on maps
• Create and manage organizations, vessels, and crew members
• Facilitate lost-gear recovery through QR code scanning and finder reports
• Transfer devices and share data access between organizations

The Service relies on LoRaWAN networks, satellite connectivity, and third-party infrastructure. We do not guarantee uninterrupted coverage, signal availability, or real-time accuracy of device positions.

4. Device registration and ownership

By registering a tracking device on the platform, you represent that you are the lawful owner of the device or are authorized by the owner to register it. You agree to register only devices you own or are authorized to manage, to not use the Service to track people, animals, or property without proper legal authority, and to comply with all applicable laws regarding the use of tracking devices in your jurisdiction. Buoy.Fish is not responsible for the physical condition, loss, or theft of your devices or the equipment they are attached to.

5. SMS communications

The Service offers SMS-based authentication and messaging. By opting in you consent to receive text messages (such as one-time verification codes and account notifications) at the phone number you provide. Message and data rates may apply. Message frequency varies. Consent is not a condition of any purchase. Reply STOP to opt out or HELP for help at any time. 6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harass, stalk, or track individuals without their consent
• Submit false or misleading found-gear reports
• Resell or redistribute access to the Service without our written consent

7. Intellectual property

The Service, including its design, code, logos, trademarks, and content, is owned by Buoy-Fish, Inc. and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of any data you upload or generate through the Service; by using the Service, you grant us a license to store, process, and display that data as necessary to provide the Service.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEVICE LOCATION DATA WILL BE ACCURATE OR AVAILABLE IN REAL TIME; OR THAT LOST OR STOLEN EQUIPMENT WILL BE RECOVERED THROUGH THE SERVICE. You use the Service at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUOY-FISH, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Buoy-Fish, Inc., its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any data or content you submit through the Service.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service at our discretion if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately; we may retain certain data as required by law or for legitimate business purposes.

12. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the practices described there.

13. Modifications

We may update these Terms from time to time. When we make changes, we will update the effective date at the top of this page. Material changes may be communicated via email or an in-app notice. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing law and severability

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
